以“双元价值”为基点论刑事诉讼中的“适度平衡”

刑事诉讼中存在公正与效率;打击犯罪与保障人权;程序公正与实体公正等两两配对的双元法律价值,双元法律价值在刑事诉讼中并不总是平行的、对等、和谐;二者之间存在一种此消彼长,互相排斥的关系。在刑事诉讼中必须以适度平衡来调节双元法律价值,以避免一种价值过重压倒另一种价值。适度平衡允许在刑事诉讼中双元法律价值沿不均衡的轨道运行,一种价值在特定时期可以高于另一种价值,这有利于刑事诉讼实质公平和形式公平的实现。本文论述了适度平衡的必要性,适度平衡内容、适度平衡的价值及其在实践中如何运用。
