| 摘 要： | 在中国古代历史演进中,宋代法制的价值功能随社会经济的跃进而明显变化,在立法和司法实践中呈现许多文明特征。突出表现在:宋代重视法律对经济生活的调整、规制,对民众的主体地位和个人意志、私人契约有一定的认知,对民众利益的保护达到前所未有的程度。

| Abstract: | During the evolvement of ancient Chinese history,with the development of society and economy in the Song Dynasty,the value functions of the legal system varied distinctly.In many ways,it made progress such as establishment of the legal system and judicial practice.which especially reinforcing the adjustment to the economic living,claiming and respecting the major position,personal will and contract of the people,and protecting the people's benefits to the unprecedented level. |
