我国社区矫正制度研究

我国已经在各地逐步开展社区矫正工作,并且在工作中取得了良好的效果和一定的工作经验,但是由于我国自建国后在刑罚执行的方式上始终是以监禁刑为刑事处罚的核心方式,而且开展社区矫正制度的时间还很短暂,所以不可避免地在建立和实行该项制度中存在着诸多问题,因此,应结合现代司法理念和人类社会刑罚观念的进化,就我国建立健全社区矫正制度应进行深度思考。

Community Correcting System In China

Community correction has already been implemented around our country in order,with good results achieved and experience accumulated;however,problems do exist in the construction and implementation of this system,for imprisonment penalty has been the key means for criminal penalty ever since the foundation of our nation and correction system has been in practice only for a short periods.This thesis,in combination with modern judicial thought and the evolution of social penalty ideology,aims to make a further consideration of how to construct and optimize this system.
