作为一种主观且可变进程的全球化——对中国法学"全球化论辩"之客观必然性预设的批判

在中国法学的"全球化论辩"背后,还在更深的层面上隐含着另一个把全球化的趋势视作是一种客观且必然的历史进程的共同理论预设。基于全球性与全球主义高度互动的视角,这一理论预设在根本上掩盖了全球化作为一种特定的主观之物或一种特定意识形态建构之物的可能性,也使人们根本意识不到全球化或"法律全球化"实际上是一场有关"全球化"性质和方向的"话语争斗";基于中国与全球化关系框架来看,在这一理论预设下无论是顺应之策还是拒绝之策,都具有一种完全丢失中国自身立场或视界的被动特征,而完全意识不到作为全球化与反全球化进程中的任何成员——尤其是中国——积极参与重构或重塑全球化进程及其方向的可能性。

Globalization as A Subjective and Alterable Process: A Criticism on Inevitability-Presupposition of "Argumentation on Globalization" in Chinese Legal Science

Behind the "argumentation on globalization" in Chinese legal science lies in a deeper sense the common theoretic presupposition of viewing globalization as an objective and inevitable historical process.With the interaction between globality and globalism as a point of view,this theoretic presupposition,in its final analysis,obscures the possibility of globalization as a subjective or ideological construct and blinds people from the fact that globalization or the globalization of law is a "discursive struggle" concerning the nature and direction(s) of "globalization".From the perspective of the relational framework between China and globalization,the agreements or disagreements concerning globalization under this theoretic presupposition has the passive feature of losing China's own standpoint and contributes to the unconsciousness towards the possibility of the active participation in the reconstruction or reshaping of the process and direction of globalization by all the state members of globalization or anti-globalization,esp.China.
