Abstract: | ABSTRACT Current rules of evidence restrict the use of sexual history evidence in civil sexualharassment cases. This paper argues for an extension of those restrictions to civil product liability litigation. The discussion focuses on the use of questions regarding sexual history during discovery and at trial in medically-related mass tort litigation and the potential repercussions this has on women and their cases. |
