网络游戏“外挂”的认定与处罚

擅自运营的“外挂”软件没有经过国家有关部门的审批，涉及程序违法；同时，“外挂”软件的运行会侵犯著作权人、出版机构以及游戏消费者的合法权益，严重扰乱市场秩序，涉及内容违法。所以，擅自使用“外挂”软件挂接运营他人网络游戏，属于非法互联网出版活动，依据《最高人民法院关于审理非法出版物刑事案件具体应用法律若干问题的解释》第11条的规定，情节严重的，可以非法经营罪定罪处罚。
