我国遗传资源的获取和惠益分享立法研究

当前,我国遗传资源流失的问题非常严重,现有的法律存在较多的缺陷,无法有效阻止遗传资源的流失.因此,我国有必要遵照《生物多样性公约》的要求建立遗传资源的获取和惠益分享法律制度.我国应当采纳单独或专门立法的模式,未来立法应包括目标和原则、适用范围、国家主管部门、获取程序、事先知情同意和共同商定条件、惠益分享和监测机制等七个方面的核心内容.

On the Access and Benefit- sharing of Chinese Genetic Resources

At present,genetic resources of our country have been losing.This is a very serious issue.Existing legal systems have many drawbacks and they cannot effectively prevent the loss of genetic resources.Therefore,it is necessary that our country should establish the regime of access to genetic resources and benefit-sharing according to Convention on Biological Diversity.Our country should adopt the approach of special law,and this regime should consist of seven core elements,namely objectives and principles,scope of application,national competent authority,access process,prior informed content and mutually agreed terms,benefit-sharing,monitoring mechanism.
