本文主要探讨公用事业领域消费关系中的不公平交易条件及消费者保护问题.针对此类不公平交易条件的表现方式和特点,本文主张一方面检讨反不正当竞争立法和实施状况,加强反垄断执法机构的权威,发挥其控制不公平交易条件的作用;另一方面完善消费者保护法,发挥消费者组织在控制不公平交易条件、保护消费者中的作用,从而在政府和消费者两个层面加强对消费者的保护.

Issues in Consumer Protection and Unfair Contractual Terms in Public Utility Area

This article mainly discusses the issues of consumer protection and unfair contractual terms of consuming relations in public utility area. In view of the presentational forms of such unfair contractual terms and their characteristics, the article holds that law against unfair competition and its implementation be examined and improved to strengthen the authoritativeness of anti-trust enforcement agencies for a better control of unfair contractual terms, and on the other hand, consumer protection law be improved so that consumer associations could play a greater role in controlling unfair contractual terms and consumer protection. With joint efforts of both the government and consumers themselves, consumers could be effectively protected.
