| 摘 要： | 《国家赔偿法》已实施12余年之久，在国家赔偿范围、违法归责原则、赔偿标准、国家追偿权等方面存在许多问题，已经不适应当前国家赔偿工作的实际需要，国家应当建立完善的听证程序，彻底改变目前不公开审理的方式，确保司法公正；为保障国家追偿权的正常行使，应尽快制定国家追偿程序方面的法律制度；进一步深化国家赔偿制度的改革，建立符合中国特色的国家赔偿管理体制。

| Abstract: | State compensation Law,which has been implemented 12 years that has many problems in the aspect of compensation scope,imputation principle,compensation standard and state compensation recovery right,has not fit in with current state compensation demands.So hearing procedure of state compensation should be perfected to realize judicial justice.Legal system about state debt reclamation in China should be established as soon as possible to guarantee state exert compensation recovery right.Furthermore,state compensation system should be further reformed to establish state compensation management system with Chinese Characteristics. |
