| 摘 要： | 作为特殊抵押之一的共同抵押制度,由于能够弥补普通抵押的固有缺陷,更加有效地实现保护债权人债权之目的,现已为大多数国家立法予以确认。本文将共同抵押界定为为同一债权的担保,基于数个不动产上成立之复数抵押权,并在此基础上对共同抵押的设立、效力等问题加以分析,以对该制度在我国的建立及完善提出建议。

| Abstract: | Joint mortgage, one of the special mortgages,has been confirmed by the legislation of most countries it can make up the inherent h'mitation of general mortgage and realize the aim of protecting the creditor's claim more effectively. In this article, we define joint mortgage as a security of the same creditor's right , which was the plural right of mortgage based on several estate , and we also analyze the institution , effect and other issues of joint mortgage then raise some suggestions on how to set up and perfect this system in China. |
