| 摘 要： | 本文在介绍香港仲裁制度和１９９６年香港仲裁条例主要修改内容的基础上，对该条例进行了若干讨论，认为１９９６的香港仲裁条例是英国法律传统的延续，它既符合仲裁法的最新实践，又保留了传统乡土社会中纠纷解决机制的特色。但是，１９９６年香港仲裁条例没有解决回归后香港如何直接承认与执行祖国大陆仲裁裁决的问题。

| Abstract: | Based on the introduction to the arbitration system and the Arbitration Ordinance(1996) of Hong Kong, the writers think that the 1996 Aritration Ordinance is the continuity of the British legal system, it keeps in close touch with the latest development of the arbitration laws and retains the vernacular styles of the resolution settlement mechanism,but 1996 Arbitration Ordinance does not settle the problem as to direct recognition and enforcement of the award made in the People's Republic of China. |
