宪法约制刑法的中国解释

宪法与刑法同属公法范畴，无一例外地受到公权力的礼遇，在它们之间也因此形成特殊的关系，正是这种关系，使得“宪法约制刑法”注定成为了民主政治所无法回避的世界性命题。事实证明，与其由国家直接控制刑法，远不如交由完法约制更为妥适；宪法可以对刑法施加政治影响，但其广度和深度也需要有所约束；刑法固有的价值取向如与宪法发生冲突，宪法原则何以成为解围的准则；当主权被置换为管理权、且以此名义制定了刑法并用以控制作为个体概念的公民时，宪法与刑法之间趋于表面化的互动关系何以成为隐藏权利与权力博弈的庇护所，等等，所有这些内容无一不是法学理论的重要课题。如果从中国现实——包括现行的法律理念、法律框架、法律生活及法学成果等——出发进行相关的命题整合和理论推导，对提升这一边缘理论的附加值将有所助益。

The Chinese Interpretation of Constitution Law Restricting Criminal Law

Constitution law and criminal law belong to public law, both respected by public power. They thus have formed a special relationship which makes ＂constitution law restricting criminal law＂ a worldwide proposition democratic politics can not avoid. In fact, it is better to control criminal law by con- stitution law rather than by the government. Constitutional law can impose political influence on criminal law, but its width and depth are restricted. If the inherent value of criminal law has conflict with constitu- tional law, the principles of constitutional law are the criteria. How the externalized interaction between constitutional law and criminal law becomes the asylum of hidden rights and power game, when the sover- eignty is replaced as management power, and formulates criminal law in its name to control citizens is an important project in law theory. If we integrate related propositions and deduce theories according to Chi- nese reality-including the current legal ideas, framework, life, achievements and so on-the added value of this periphery theory will be raised.
