论视频监控中的问题及其法律规制

在现代警务中，视频监控系统对于社会秩序之维护、警察任务之完成有着积极的作用。但由于缺乏基本的法律授权和法律规范，视频监控系统对民众的宪法基本权有侵害之虞。故此，遵循警察补充性、正当法律程序、合目的性、安全保护等基本原则，并从设置主体、设置地点、设置实质标准、监控系统选择等方面强化视频监控的法律规制，才能真正发挥视频监控的应有作用。

Research on Video Surveillance System and Its Regulation

In modern policing, video surveillance system is of active importance to the maintenance of social order and completion of police assignments. However, short of legal authorization and regulation, it will infringe people＇s constitutional rights. Therefore, measures should be taken to strengthen the legal regulation of video surveillance from aspects such as subject, place and substantial standard of the setting, and selection of surveillance equipment, following the basic principles of complementarity of the police, due process of law, purposiveness and safeguard. In this way, the due function of video surveillance can be fulfilled.
