侦查主体体系分析

侦查主体属于侦查学的基本理论范畴，而当前对侦查主体的概念和内涵界定存在分歧，为此，可在分析不同侦查主体界定的基础上，从侦查权的视角探究侦查主体的涵义，进而构架一个由三个层次构成的侦查主体体系：侦查权的所有者——国家；侦查权力和侦查义务的承担者——侦查机关；侦查权的行使者——侦查组织。这三个层次构成了侦查主体的完整体系。

Analysis of Investigation Subjects System

Criminal investigation subject is the basic content of criminal investigation discipline. As its conception and connotation concerned, there are lots of opinions. Therefore, this paper focuses on the def- inition of criminal investigation subjects from investigation power after analyzing the constitution of dif{er- ent criminal investigation subject. Meanwhile, the paper separates the criminal investigation subject sys- tem into three levels. Simply speaking, it is consist of state the power owner, criminal investigation or- gans the undertaker of investigation power and compulsory, and investigation organization the executive of investigation power. All of these constitute the integrated system of criminal investigation subjects.
