| 摘 要： | 借人与借用人承担连带责任已经不适应社会发展和时代要求,在出借车辆肇事案件中,无偿出借人应依过错责任承担责任,有偿出借人应依无过错责任在获利范围内承担补充责任,不能任意扩大责任主体和责任范围。

| Abstract: | That the lender and the borrower took joint liablility no longer meet the requirements of social development and the times.In lent vehicle accident cases,the unpaid lenders should assume responsibility according to fault liability,while the paid lenders should assume added responsibility in the context of profit according to nofault liability.The subject and areas of responsibility can not be expanded at will. |
