羁押必要性审查制度之审视与完善

羁押必要性审查制度,是我国羁押法律控制体系中的一项新举措。作为一项新生制度,其在适用范围及阶段、启动方式、审查主体、内容等方面均存在一定问题。完善羁押必要性审查制度,可以采取以下措施:改进审查工作方式,做到全面审查与重点审查相结合,明确监所检察部门负责审查起诉阶段的案件,强化程序启动的刚性,建立审查程序中的检察员过失豁免制度,补充相关审查内容等等。
