社区矫正理念衔接问题研究

社区矫正在我国作为新生事物,是对传统刑罚执行方式的一种突破与创新。而新制度构建的快速性使得理论,法律与执法实践都出现了衔接隐患。理论与实践上的空间错位加剧了该制度构建中相关问题之间的冲突,为此宜通过"空间还原"与"时间延长"等辅助措施缝合理论衔接漏洞。

On the Convergence Research of Community Correction Notion

As a new creation in China, community correction can be regarded as a breakthrough and innovation in relation to the traditional way of the execution of punishment. The fast construction of the new system creates convergence problems among theories, law and enforcement practices. Space mismatch between theory and practice exacerbates conflicts related to the problems. Therefore, supportive measures such as ＂space reduction＂ and ＂time prolonged＂ should be considered to remedy convergence holes.
