| 摘 要： | 随着土地资源的稀缺和建筑技术的发展,空间利用具有了前所未有的价值,空间不再附属于土地,能够独立成为权利的客体。空间权是对以一定范围空间为客体所设定的各种权利的综合表述。理论上,物权性质空间权包括：空间所有权、空间地上权、空间永佃权、空间地役权,结合实践中空间开发利用需求,我国立法只需引入空间建设用地使用权（空间地上权）概念即可,《物权法》对于空间权类型也可做相同处理。

| Abstract: | The use of space has much value and becomes the object of rights.Space right is the comprehensive statement to the various property rights setting on the certain space.In theory,space right includes types of space ownership,space superficies,permanent tenancy right of space,Space Servitude.Combining the development and utilization of space in the practice,Chinese legislation just need introduce the concept of space usufruct of construction（space superficies） land as well as the Property Law. |
