| 摘 要： | 破产重整制度作为我国新破产法中首次规定的一种创新性制度,必须合理的平衡和处理雇员利益和企业利益的关系。借鉴两大法系破产立法的相关规定,我国的破产立法应该在实体、程序及争议解决等方面加强对破产重整企业中的劳动者权益的维护。

| Abstract: | The reorganization system is the first rule of new insolvent law in our country,which helps to attain a balance of interests between the management and the work force.Furthermore,it is of great importance to safeguard the legitimate rights and interests of workers in substantiality,procedures and settlement of dispute through learning the foreign rules and regulations on insolvent laws. |
