| 摘 要： | 我国<婚姻法>经2001年的修订,确立了离婚过错赔偿制度,体现了对无过错方和弱者的保护,具有填补精神损害、抚慰受害方、制裁过错方的功能,是我国婚姻家庭制度史上的一个突破,也体现了充分尊重和保障人权的理念.但近几年的司法实践表明,离婚赔偿的举证责任难以履行,影响了此制度的实施.所以,在我国相关立法及司法现状的基础上,完善离婚赔偿的举证责任是必要的.

| Abstract: | The amendment of Marriage Law in 2001 establishes divorce fault compensation system,embodies the protection against the blameless and the weak,bears the function of remedying the mental loss,pacifying the victim and punishing the faulty. It is a breakthrough in the marriage family system in China and demonstrates the idea of respecting and protecting human rights.But legal practices in these years shows that the onus probandi of divorce fault compensation can hardly be honored.Therefore,it effects the fulfillment of the policy.As a result,on the basis of the current legal situation,it is necessary to improve the onus probandi of divorce fault compensation. |
