构建公立高等学校二元行政法律地位

从公立高等学校的发展历程及我国司法实践和理论研究的现状人手,通过比较国外高等学校行政法地位的理论实践,提出行政权是确定我国公立高等学校的行政法上地位的动态标准.并进一步从公立高等学校作为行政相对人、行政主体两个纬度进行分析,厘清公立高等学校在行政法的具体司法实践中的二元地位.

Dualistic Positions of Public University in Administrative Law

The article starts from the development process of the public university and the present conditions of the judicatory practice and theory research in China.By comparing the status of foreign university in administrative law,this article puts forward the idea that the administrative power is the dynamic standard of defining the status of Chinese public university in administrative law. It analyses public university from two aspects of private party in the administrative process and administrative subjects and clarifies dualistic positions of public university in the judicatory practice of administrative law.
