BOT特许权协议的法律性质及适用

BOT是政府借私人融资建设和经营力量兴建基础设施和公用设施的方式,且该私人和贷款方从投资中获利。为此,政府与该私人作为项目发起人设立的项目公司签订特许权协议。特许权协议兼顾代表公共利益的政府利益和私人利益,是二者妥协的产物。在完善的市场经济条件下,特许权协议应定性为经济合同,这样比较有利于公共利益和私人利益的平衡。
