| 摘 要： | 德国是立法上明确规定起诉法定原则的代表国家 ,然而自 19世纪 2 0年代以来 ,德国检察官的公诉裁量权日益扩大。考察德国公诉裁量权的发展历史 ,并分析其原因 ,对我国公诉裁量权的完善无疑具有重要意义。
