| 摘 要： | 西方沉默权被认为是一项自然权利,是人权的组成部分,是一项实施无罪推定的权利。文章从沉默权的概念、历史沿革入手,对沉默权制度在中国适用的必要性,以及这种制度在发展的进程中应注意解决的问题作了探讨。
