论消费者的弱势地位及其法律矫正

消费者权益保护法以及其他相关法律法规虽已实施多年，但消费者权益的保护在我国仍然处于初级阶段，对其制度研究则多限于实务角度。本文立足于消费者权益保护的基本问题，从法学和经济学的角度分析了消费者弱势地位的四种具体表现，以及作为“经济人”的经营者如何利用消费者的弱势地位对消费者权益进行侵蚀。在理论分析基础之上，从消费者权益保护核心概念的修正、基本制度及标准的健全、诉讼制度改革和如何发挥法律的引导功能等层面提出了相应的法律矫正措施。

Although the consumer rights protection ordinance and other related law have already carried out for many years,the protection of the consumer rights still is placed in the lower stage in our country,as to it research on system then is limited by actual situation angle more.This paper is based on protective and basic problem of the consumer rights,learn to analyzed the consumer minority position four kinds of to express in a specific way with the angle of the economics from the method,and how the conduct and actions executive of" economic person" is the minority position of the exploitation consumer carries on the erosion to the consumer rights.Analytical foundation in the theories on,protect the correction,basic system of the core concept and standard sound from the consumer rights,the litigation system reform and how develop the leading function of the law etc.the level puts forward the homologous law to correct the measure.
