中国法理体系的演进及其启示

中国法制现代化的进程启动以来,中国的法理体系经历了“三破三立”的新旧体系演进过程。第一次是中国传统的封建性质的法理体系的解体和近代带有资本主义性质的法理体系的建立;第二次是“旧法体系”在中国大陆的彻底摧毁与维辛斯基法理体系的确立和极端化;第三次是“以阶级斗争为纲”理论模式的被突破与中国特色法理体系的初步形成。通过对一百多年来法理体系变迁的回顾,可以从中得出不少启示：一是中国的法制现代化建设必须从中国的实际出发;二是必须注重对中国传统法文化的批判继承;三是应该正确看待马克思主义在法学理论研究中的作用;四是要继续为法理研究创造一个更加自由宽松的争鸣环境。

Evolution of Jurisprudential System in China and Its Inspiration

Since the start of modernization of legal system in China, the jurisprudential system has undergone "three times of abolishment and three times of establishment" evolution from an old to a new system. The first is the disintegration of Chinese traditional jurisprudential system with feudal character, and establishment of modern jurisprudential system with capitalist character. The second is complete smash of "Old Legal System" in the Mainland of China, and establishment and extremelization of Weisonsky's jurisprudential system. The third is the theoretical mode of "taking class struggle as a guiding principle" being broken through, and the jurisprudential system with Chinese characteristics initially taking shape. By reviewing the changes in the jurisprudential system in the last hundred years, a lot of inspirations can be got. In the first place, construction of modernization of legal system in China must proceed from the practical situation. Secondly, much attention must be put on critically carrying forward the Chinese traditional legal culture. Thirdly, function of Marxism in jurisprudential study should be correctly treated. Finally, a more free and comfortable contending circumstance will proceed to be created for the study of jurisprudence.
