仲裁发展的障碍问题探析

我国仲裁法尚未达到立法者预期的目的。其主要原因，一是社会对仲裁的认知明显不够；二是法院对仲裁存在认识上的误区；三是仲裁法在制度设计上存在缺陷；四是不少仲裁机构先天不足，自身问题较多。尽快排除这种障碍，是仲裁发展的当务之急。

Discussion on Problem of Obstacles on Arbitration Development

The Arbitration Law of China does not achieve the desired purpose. As to the main reasons, first, the society's recognition of arbitraton is obviously insufficient; second, the misunderstanding of court's recognition of arbitration; third, there are some shortcomings of arbitration law in the design of its system; and fourth, a good many arbitration agencies are congenitally deficient,and they themselves have many problems. Removing these obstacles as soon as possible is a task of top priority for the development of arbitration.
