调解执行及调解协议的效力问题是随着社会转型逐渐凸显的,在现今中国调解制度的架构下,经法院确认的调解协议具有申请强制执行的效力是一种历史的选择,也是调解制度得以进一步推行和发展的关键。新中国调解制度文本的历史勾画出调解执行及调解协议效力的直观变化过程。＂传统权威＂的逐渐解体,国家对调解社会功能的期许以及社会转型的复杂情势,赋予调解协议申请法院强制执行的效力,让国家权力介入这一基于当事人＂自愿＂而构建的纠纷解决机制成为必然,这也是调解在现代社会维系的必要条件。

The Remodeling of Mediation Agreement on the Social Transformation Dimensionality --An Analysis Base on the Changes of Meditation System Text

The execution and low effectiveness of meditation have been gradually highlighted with the social transformation. Therefore, under current legal system, the implementation of meditation agreements is an choice of history, which is key to the development of meditation system. The history of new china shows that the visual changes of the mediation . This thesis aims to lay out the changing process of the meditation execution and the mediation agreement, through observation and analysis of the meditation system text from a historical perspective. Through analyzing, we found the facts that the gradual disintegration of the traditional authority, the country＇s expectation for the social function of the meditation process and the complexity of the situation of social transformation have proposed urgent requirement for enforcing the execution, which enables the interference of the national authorities into the dispute resolution mechanism which is essentially based on the parties＇ own will. On the whole, this change is an inevitable choice as well as an indispensable condition for the maintenance of the role of the meditation in modem society.
