| 摘 要： | 我国的刑事诉讼法律没有对辨认作出适当的规定，辨认笔录的证据能力和证明力，也就一直是个争议不休的问题，尽管在实践中，辨认笔录的证明力有其深厚的理论基础，但由于辨认本身所存在的问题，辨认笔录的证明力并未达到充分的境地。从辨认本身所依据的规律出发，完善辨认的程序，是提高辨认笔录证明力的必然途径。

| Abstract: | Criminal Prusecution Law in China has not given the suitable stipulation to the identification,so record evidence＇s ability and the certificate strength are always a continuous disputing question.Though the testifying force of the identifying notes has a deep theory foundation in practice,it bas not reached a sufficient extent because of self problem.At the basis of the law of idetifying,it is the necessary approach which improves the ability of identifying notes to perfect the identifying procedure. |
