民事再审程序重构

本文在考察和分析国内民事再审程序立法现状的基础上 ,借鉴国际发达国家的立法经验 ,提出了重构再审程序的理论及重构这一理论的价值取向问题 ,从而寻求符合中国司法改革实际的立法原则及相应对策。

Re-Construction of the Re-Sentencing Procedure in Civil Cases

Based on the review and analysis of legislation concerning re-trial in civil procedure of our country, making reference to the counterpart legislative experiences of some developed countries, this article raises the theory and the values to re-construct the re-trial procedure and so as to seek the legislative principles and corresponding measures in conformity with China's judicial reforms.
