关于《中国入世议定书》中替代国条款的思考

反倾销法之中的替代国制度是发达国家进行贸易保护惯用的手段 ,我国外贸行业领教已久 ,可《中国入世议定书》仍规定WTO其他成员方对中国可继续适用这一制度。本文探讨了替代国制度的产生背景和多边立法依据 ,比较分析了各主要发达国家替代国制度的内涵与特点 ,译例了我国《入世议定书》的替代国条款及其它实施条件 ,并就中国今后如何合理合法地直面外国的替代国制度提出了全面又有针对性的设想。

Substituting State Clause in Protocol on the Accession of WTO of the PRC

Substituting state in anti-dumping is a commonly used measure by developed for countries trade protection.Enterprises of our country engaged in foreign trade have suffered from that for long.The Commitment of The PRC in Entering The WTO provide that the member of WTO can apply this clause to China.This article researches the background and legal ground of the clause, the implication and characteristics of the clause in some developed countries.The article translates the clause and its applying conditions in The Commitment and raises some points for China to reasonably and legally deal with the clause.
