| 摘 要： | 主权是国家的身份 ,而非国家的权力 ,这种身份来自于明示或默示的约定 ;作为国家身份的主权是不能分割、不能让渡的 ;所谓“主权限制” ,除非是外来的强制 ,其实是主权的行使方式 ;全球化使国家置身于更多的“契约”约束之中而并未减损国家的身份。

| Abstract: | Sovereignty is state's status, instead of state's power. Such status derives from expressed or implied contract. Sovereignty as state status can neither be divided nor be transferred. Limits to sovereignty are limits to forms of exercising sovereignty, unless the limits from outside. Under globalization states are bound by more contracts but states' status are not lessened |
