建立与发展中国跨国企业的法律思考

鼓励对外投资、建立跨国企业是增强国力、维护国家利益的重要措施。在我国经济、社会进步和经济全球化的背景之下 ,进一步发展我国的跨国企业是一个十分迫切的课题。在法律方面 ,我们有必要深入研究现阶段境外投资法律规范存在的问题 ,制定较为严密完整的境外投资法、制定系统的境外投资发展规划、制定保护和鼓励措施、增强法律咨询和督导 ,从而建构起一套切实而完备的境外投资法律制度。

Legal Inquiries on Establishing and Developing China's Transnational Corporations

Encouraging overseas investment, establishing transnational corporations are very important factors for a state to strengthen its capability and maintain its interests. With the social and economic developments in China, and also with the motivation of global environment, we should seriously face with the issue of further developing China's transnational corporations. In the field of law, deep research should be taken to review the problems in the status quo legal rules on China's exterritorial investment; a set of exterritorial investment legal environment should be set up by adopting a thorough exterritorial investment code, formulating a systematic exterritorial investment project, working out protecting and encouraging measures for exterritorial investment and enhancing legal consult and supervision.
