| 摘 要： | 环境法的自然观是建基于对自然属性的判断之上。自然的属性不仅局限于经济性 ,而应是经济性、生态性、精神性的综合。环境法的理念之根在于自然的三种属性 ;环境法的理念之具体表现在于九个范畴 :节制 ,持续 ,公平 ,生命 ,和谐 ,朴质 ,精神 ,仁爱 ,情性。正是有了对自然属性的新观念 ,才使得环境法呈现出不同于民法等其他法的气质 ,并且 ,环境法中出现了“伦理回归”的洪流。

| Abstract: | Environmental law's outlook on nature is based on the character of nature.Characters of nature are not only economic,but also ecologic and spiritual.The environmental law's doctrine is based on the three characters of nature and embodied in nine norms:limit,sustain,equality,life,harmony,plain,spirit,kind and love.Because of this new realization to nature,environmental law has shown different features from other laws such as civil law.Also ethics plays an important role in environmental law. |
