| 摘 要： | 我国赦免制度的现状是存而不废,存而不用,这种立法的空置无论在理论上和实践中都是难以回避的现实。通过分析产生此现象的原因,指出赦免制度尴尬处境的关键所在;并从理想与现实两个层面提出完善我国赦免制度的建议,以期使我国赦免制度摆脱目前的尴尬困境。

| Abstract: | it is difficult to avoid the fact that the status quo of pardon system is existence in legislation and desuetude in practice.By analyzing the reason of the fact,point out where the shoe pinches of the dilemma of pardon system in China,bring forward some suggestions for perfect the pardon system from ideal and realistic aspects so as to make it break away from the current dilemma. |
