| 摘 要： | 容留他人吸毒作为我国刑法中为数不多的容留类犯罪,在我国对吸毒行为非犯罪化的前提下有必要进一步厘清在适用过程中容留行为的性质及构罪条件情节要求.通过<刑法>和<禁毒法>的时比,以法益侵害理论、吸毒行为自伤理论为出发点,结合帮助性中立性行为说,可以进一步完善容留他人吸毒罪.
