| 摘 要： | 证人豁免制度的采纳需要实现在刑事诉讼理念中的一个这样的转变,即由刑法应该"不折不扣地实施"或者说"有罪必罚",向通过"交换"或者放弃对一些犯罪的定罪而实现更大的惩罚犯罪的效果。要做到这样一种转变,我们需要面对的是在成文法上、刑事诉讼法理通说、民众的心理承受度的考察。只有在对这些问题都做好准备之后,我们才能在立法上对证人豁免制度作出必要地回应。

| Abstract: | The adoption of the witness immunity system demands a concept transfomation from "all crime must be punished" to achieving bettern effect of punishing crimes through abandoning certain punishment.To achieve such transformation,we will inspect the statute law,general theory of criminal procedural law as well as people s psychological endurance.Only when all these issues be prepared,can we respond to the witness immunity system in legislation. |
