| 摘 要： | 上诉程序是刑事诉讼一个极端重要的环节。香港和内地在上诉制度上存在许多不同之处,分析两地在刑事上诉制度中的区别,可以达到取长补短的作用。从上诉制度的基本问题着手,分析香港和内地在上诉的提起、上诉案件的审理和上诉案件的裁判三方面的不同之处,对于两地刑事司法制度的相互借鉴有着重大的意义。

| Abstract: | Appealing procedure is an extremely important link in criminal litigation.There are lots of difference in the appealing system between Hong Kong an inland.Analyzing their differences can make the best of both.Starting with the basic problems of appealing system,analyzing the differences in the file of appeal,trial and judgement of appealing cases bewteen Hong Kong and inland is of great significance to both the criminal judicial system. |
