| 摘 要： | 公共利益在诸国宪法例中都有表述,我国也类似,但在我国现实的行政征收征用中却时有异化。当前应放弃对其含义和标准制定上过多的争论,选择正当程序模式,以综合控权机制达成公共利益的正当实现。

| Abstract: | The concept of public interests has been delivered in many nations' constitutions,so has done China.However,the concept is dissimilated when it is turned into the practical cases of administrative expropriation.For now,the thing is to give up arguing and quarrelling with what about the connotations and standards,instead,to choose the right procedural mode and exercise the leverage of concerted administrative power control to fulfill the rightful public interests. |
