| 摘 要： | 我国民法学界实际上在两种意义上使用“请求权”这一概念”,但理论上并未对其各自的性质正确地加以区分,从而引起了相关概念之间的混淆。本文分析认为,两种请求权性质上分属权能和救济权,故将之区分为“权能性请求权”和“救济性请求权”,并对各自的概念予以界定。

| Abstract: | Practically, the present civil law academic circles use the concept"claim"in two meanings, but in theory, they do not differentiate their different nature correctly, which causes the confusion among relevant concepts . This article analyzes this issue , holds that the two kinds of " claim " in nature are "powers and functions"and "remedial rights "respectively , differentiates them as"chaims as powers and functions"and"claims as remedial rights",and then defines them respectively. |
