| 摘 要： | 夫妻财产制度是我国《婚姻法》中的一个重要内容 ,现行的夫妻财产制度规定了法定财产制和约定财产制 ,法定财产制作为约定财产制的补充。但《婚姻法》对于夫妻财产制度的规定仍存在着不明确的缺陷 ,建议将夫妻婚后所得共同制作为夫妻法定财产制 ,明确夫妻个人财产的范围 ,进一步完善夫妻财产约定制。

| Abstract: | The property regulations between husband and wife take an important position in the Marriage Law of China, Generally speaking, the present regulations provide two kinds of property system, namely legal property system and appointed property system, in which the latter acts as an important complement of the former. But Property regulations still exist uncertainty in the Marriage Law. My suggestion is that all the income after a marriage should be included with in the legal property system. The certain range of a husband's of a wife's individual property must be accurate in order to perfect the appointed property system of a marriage. |
