| 摘 要： | 传统旧实体法学说在给付之诉诉讼标的的识别问题上存在理论缺陷,之后出现的各种识别学说也无法自圆其说。因此,有必要对各种流派学说进行述评与反思,找到较佳的解决路径。决不能因为旧实体法学说存在一点理论缺陷就抛弃其整个理论,而应通过修正民事实体法来解决来源于民事实体法上的请求权竞合而导致的旧实体法学说的缺陷。

| Abstract: | It is necessary to carry on reviewing various school theories for the better settlement route.The great deal of reasonable theory that old substantive law theory has should not be abandoned because of a bit defect and the old substantive law theory should be amended through the revision of the civil substantive law which causes two kinds of right of petition existed in the same time. |
