| 摘 要： | 根据《中华人民共和国物权法》(草案)第112条的规定,赃物限制适用善意取得制度。但是,从善意取得制度重在保护交易安全的价值取向出发,用构成要件控制其运用,借鉴国外的立法例,赃物应该完全适用善意取得制度。

| Abstract: | As the 112th article in "Law of Real Right in People's Republic of China "(draft) states,the limitation of spoils is applicable to the system of bona fide acquisition.Nevertheless,from the viewpoint that the system of fide acquisition focuses on keeping the safety of deals and using constitutional part for the control of its implication,the spoils should completely be applied to the system of bona fide acquisition when borrowing the references from abroad. |
