行政许可法视角下治安管理的反思及重构

随着《中华人民共和国行政许可法》从2004年7月1日起实施以及行政审批制度改革的深入,治安管理工作面临前所未有的重大挑战,治安管理泛宽化必然弱化社会治安管理力度,如何适应社会发展,遵循市场经济法则,充分汲取社会资源,彻底走出行政许可取消后治安管理面临的困境,把工作重心从事前许可转移到事中监督和事后查处上来,推动治安管理制度化、规范化和法制化,这是构建治安行政许可取消后治安管理机制与模式的宗旨所在。

Review and Up-building of the Management of Public Order from the Visual Angle of Administrative Permission Law

With the implement of "the Administrative Permission Law of the People's Republic of China" from July 1st 2004 as well as our deepening the system reform of administration examination and approval, the management of public order is faced unprecedented challenges,and extensive management of public order will inevitably weaken the management of public order. This paper points out, after the cancellation of administrative permission of public order, our purpose of building the mechanism and pattern of public order management is as follows: to meet the need of social development, follow market economic rule, make full use of social resource, thoroughly extricate from the predicaments in management of public order transfer the heart of our working from beforehand permission to supervision of the matter and afterwards investigation, to institutionalize, standardize, and legalize the management of public order.
