WTO许可程序规则对我国行政许可制度改革的启示

改革行政许可制度是我国建立社会主义市场经济体制的重要一环,WTO许可程序规则所确立的许可理念,对我国行政许可制度改革具有重要的启示。针对我国行政许可制度存在的行政许可权的设立、运行机制及责任制度的缺陷,在制定统一的行政许可程序标准法、确立行政许可适用的有效范围、确立我国行政许可制度的一般适用原则等方面应大胆借鉴WTO许可程序规则,改革我国的行政许可制度。

Reform of administrative permit systemis an important link of set up socialist market economy system in our country. The rule of permit procedure established by WTO has important enlightenment to our country' s reform of administrative permit system. Aiming at our country' s establishment of administrative permit power, operation mechanism, and defect of responsibility system, we should use for reference from WTO' s permit procedure rule in aspects of constituting unified standard law of administrative permit procedure , establishing effective range of administrative permit applicability and generally applicable principles in order to reform the admiristrative permit system of our country.
