| 摘 要： | ADR发端于美国，是替代性纠纷解决方式的总称，其对社会纠纷解决发挥了很重要的作用。文章通过对ADR的特征与价值的分析，从法理学的角度分析其在纠纷解决过程中的优势，以及与法治建设的密切关系，以期能够为中国当下非诉讼纠纷解决机制的发展提供借鉴。

| Abstract: | ADR, coming from the United States, is the general term for the alternative dispute resolution. In the settlement of disputes it has played a very important role. Based on the analysis of characteristics and the value of the ADR, the article analysis its advantage in dispute resolution process from the point of view of jurisprudence, and its close relationship between the rule of law, and provide the reference to the development of non - suit dispute resolution system. |
