民事行政争议关联案件诉讼程序研究

在审判实践中,经常出现行政诉讼与民事诉讼相互关联、相互影响的案件,但我国相关立法及司法解释却没有作出相应的规定。本文在对此类案件进行类型化分析的基础上,就其处理模式、审理顺序、行政附带民事诉讼的范围、行政诉讼与附带民事诉讼的冲突等问题作了简要分析,并提出了自己的一些看法。

A Study on the Litigational Procedure of Civil Cases Related to Administrative Disputes

In the judicial practice, we often meet cases that administrative litigation and civil procedure relate and influence each other. But there are no respective law or judicial interpretation on this aspect in China. Based on analyses of this kind of such cases, this essay briefly analyses the handling models, trial sequences, the scope of incidental civil action during the course of the administrative litigation, conflicts between administrative procedure and incidental civil procedure. At the same time the author provides some own opinions.
