中国经济法的经济根基——从《十一五规划》谈起

以《十一五规划》为切入点,可以看出,中国经济法经济根基的基本现实是社会主义市场经济不完善且正在探索建设好的市场经济;而现有经济法理论却一直以“市场失灵”为经济法的根基,这就导致了种种理论局限甚至消极影响。将“市场失灵”概念中国化,使之涵盖“市场不完善”的含义,从而使中国经济法的经济根基理论本土化,这不仅必要,而且可行。中国化的“市场失灵”概念既具有一般的方法论意义,也可能克服原有的理论局限。

On Economic Foundation of Chinese Economic Law: From the Angle of the 11 th Five-Year Plan

To survey theories concerning the economic foundation of Chinese economic law from the angle of the 11th Five-Year Plan,we can readily conclude that our socialist market economy is imperfect and we need to find a way to better it.Unfortunately,theories of economic law have,since the very beginning,taken“market failure”as its foundation,which inevitably results in restraint of the theories and even adverse effects.As such,to sinicize“market failure”and make it smack of“market imperfection”is not only necessary but available,by which theories concerning the foundation of Chinese economic law will be readily localized.Apart from general methodological meaning,advocating the Chinese-styled“market failure”is conducive to breaking the theoretic restraints.
