| 摘 要： | 人文精神确立于现代社会,为我国刑法的修改提供了新动力,它的落实要求在刑法的立法和司法过程中做到“以人为本”。新颁布的《刑法修正案（八）》从人性、人道和人权多个方面体现了人文精神,立法者和司法者应通过对其内容的研究,促使刑法同人文精神更好地结合,使得我国刑法更趋合理和文明。

| Abstract: | The establishment of humanistic spirit in modern society provides new driving force for the modifica- tion of the criminal law of our country. Making the humanistic spirit practicable asks for people - oriented attitude in amending criminal law. We should analyze the humanistic spirit of criminal law through studying the revised con- tents of new criminal law and explore how to make the criminal law be integrated better with the humanistic spirit so as to make our criminal law more rational,reasonable and civilized. |
