网络犯罪的刑法规制论

由于网络犯罪的隐蔽性、远程性、无地域性等特点，致使传统刑法在规制网络犯罪之时往往举步维艰。本文从网络犯罪的刑法界定引出，通过有针对性地考察西方主要发达国家的网络犯罪刑事立法和打击网络犯罪的国际公约，归纳域外刑法规制网络犯罪的有效经验，通过比较和借鉴，分析我国现行刑法在规制网络犯罪方面的诸多缺陷。进而提出了完善我国现行刑法的具体建议。
